All references to the “Company” in these terms and conditions shall mean Angara Tours and Travel Ltd, a limited liability company providing destination management services in Kenya, Tanzania, Rwanda and Uganda. All references to the “Organizer” shall mean the person, firm or company contracting with the company of services (hereinafter defined) to be provided to clients (hereinafter defined)
All references to “Client” shall mean the person, firm or company to be provided with services by the company and which are contracted for with the company by the organizer and shall include any person in any party accompanied or paid for by such person, firm or company and the personal representative of all such persons.
  1. RESERVATIONS AND PAYMENTS 

    Reservations: When booking your holiday direct with Angara Tours and Travel, please quote the tour number of your own specialized itinerary, intended date for arrival and departure, number of people travelling in your party. This will ensure that our ground arrangement are done to your satisfaction and concise.

    When viewing animals: Caution is advised when viewing the animals, please be advised that there are no guarantees. It is such a privilege to see animals in their natural habitat, but keep a safe distance while with them and even when taking photographs.

    Gorilla Trekking: Gorilla trekking generally requires a minimum of 3 Months advance booking the permit(s). Children under 12 years are not allowed to track Gorillas. Getting a Gorilla permit is not a guarantee of seeing a Gorilla. Local conditions sometimes inhibit access to the Gorillas on a short notice. We do not accept liability for any circumstance that may lead Gorilla viewing being cancelled, whether it is closure of the national park or borders, absence of the Gorillas, security changes. Refunds are at the discretion of the relevant authority and we cannot accept liability for them. A Gorilla permit guarantees you will trek the Gorillas after payment but does not guarantee that the Gorillas will be in plain sight. However, chances of seeing the Gorillas stand at 98%.

    Payments: A deposit of 50% of the Total tour price is required at the time of confirming booking of a tour. The remainder of the total quoted tour price is due 30 Days before the commencement of the services. For reservations made within 45 Days to commencement of the services, full payment is due upon confirmation of the tour services.

    No refunds are given for: Lost travel time or substitution of facilities and or accommodations; itineraries amend after departure; not appearing for any accommodation, tour, game viewing or other booked activities; and or cutting short the booked itinerary for any reason.

  2. NON - PAYMENTS BY THE DATE FOR THE COMMENCEMENT OF SERVICES

    In the event that the company has not received payment in full by the date for the commencement of the services then the company reserves the right in its absolute discretion to withhold all or any of the services and the company shall be entitled to collect the outstanding payment from the client direct and to recover from the Organizer all cancellation fees which they are entitled to charge as per para 2 above. The company shall not be required to notify the organizer, the retailer or the client prior to the date for commencement of services that the services or any of the services will be withheld.

  3. PRICE VARIATIONS

    Before full confirmation, we also reserve the right to withdraw a tour or any part of it, to make such alterations in the itinerary as desirable to refuse to accept or retain as a member of any person at any time, and to pass on to tour members any expenditure or losses caused by delays or events beyond our control.
    Angara Tours and Travel reserve the right to revise cost of the safari without prior notice written or otherwise against the general increase in prices of other service providers (Hotels, Fuel, National park fees, Food prices, etc)
    The company reserves the right to increase all or any of the prices without prior reference to the organizer in any of the following events; 
    - Official devaluation or revaluation of the local destination currency against the United states dollar, The EURO, The Pound Sterling or the currency of the country from where the booking is made (If different).
    - Any statutory increase in taxes or other dues imposed by the local government or any officer or agent thereof;
    - Any local increase in the price of aviation fuel or motor vehicle fuel or any other increase in the cost of transport which forms part of the service;
    - Any increase in prices of accommodation or cost of meals forming part of the service;
    - Any increase in entrance fees to national parks, national reserves and sanctuaries and any other entrance fees forming Part of the service;
    - Any other increase in company operation costs or cost of providing the services which are beyond the company control and which the company has every reasonable effort to prevent.

  4. CANCELLATION

    Full refund will be made if Cancellation is made in writing within 120 days of the booking and prior to the commencement of the safari. Refund on all prepaid money will be based on tour deposits. Generally there is a 20% Charge on cancellations within 120 Days. 30% Charge on cancellations within 90 - 119 days. 50% charge on cancellations within 40 – 89 days. 75% Charge on cancellations within 15 – 39 days and 100% charge on cancellations within 0 – 14 days. Angara Tours and Travel reserves the right to deduct all administrative expenses incurred from any money paid. Gorilla permit are also not refundable.

  5. TOUR LEADER

    A bona fide tour leader discount of 100% discount will be given to one tour leader in every multiple of 30 clients booked at a time. Tour leader discount will cover only Transport, accommodation and food.

    Note: The Hotels will require final rooming list 30 days before the groups’ arrival.

  6. TRANSFER OF BOOKINGS 

    In the event that you are unable to travel due to extra ordinary circumstances, we may transfer your booking to another party or date provided the arrangement remain the same and if suppliers (Airlines, hotels, lodges etc) are ready to accept the transfer. Gorilla permits are however not refundable.

  7. MODE OF PAYMENT

    Payments can be accepted in cash at our office. You can also wire a direct bank transfer into our bank account. Payments will be accepted in foreign currency at the available exchange rate or in the foreign currency. You may also pay us through western union and Money Gram if prior notice is given on email, we can advise on the best method to use.

  8. TRANSPORT

    Angara Tours and Travel operates a fleet of comprehensively insured vehicles and the mode of transport utilized will be dependent on the number of clients and the route chosen based on the specifications of the chosen itinerary. Fully trained and experienced English speaking guides/ driver are provided.

  9. ACCOMODATION

    Based on twin bedded rooms or tents with private bathrooms where possible. Single rooms may be available with the payment of a supplement fee but can always be guaranteed. Some facilities have available double beds upon request

  10. TOUR PRICE

    The price quote are inclusive of all transportation as per the itinerary, park entrance fees, Permits where applicable and are clearly indicated, drivers allowances and third party insurance. The rates are not inclusive of meals while in Kampala, travelers, insurance (which should be purchased individually), local airport departure tax, visa fees, tips, Sodas and Alcoholic beverages, Telephone Calls, Internet, laundry and other personal expenses.

  11. CHILDREN

    Children with the age of 12 Years and below sharing rooms with two adults generally pay 50% - 75% of the rate quoted except on air Safaris, adventure programs, Gorillas and Chimps trekking where they are charged adult fees. Some game lodges and tented camps accommodate a maximum of two persons per room, an extra bed may not be provided in the room. Other restrictions may apply from time to time. Children rates are available on request.

  12. COMPLAINTS / REFUND

    If the client has a complaint/refund query about any aspect of hi/her holiday, it should be reported immediately to Uganda Angara tour’s local representative in the country who will do their best to resolve the matter during the Safari. If the problem is not resolved to the client’s satisfaction any further complaint /query should be made by client in writing to Angara Tours and Travel not later than 20 Days following completion of the Holiday. Failure to do so may mean forfeiture of claim against Angara Tours and Travel. There will be no refund on unutilized services.

  13. INSURANCE

    - All transportation in Kenya, Tanzania, Rwanda and Uganda are insured in accordance with and to the extent required by the laws of the respective destination.

    - The company insurance does not cover illness, medical expenses, damage to or loss of baggage and consequential damages arising from any of these or at all and the organizer must advise the clients to effect their own insurance prior to their arrival in the local destination and such insurance must cover as a minimum death, personal injury, Medical expenses, damage to or loss of baggage and consequential damages arising in the event of any of the foregoing.

    You are advised to buy travel insurance through your agent before coming to Uganda, but local evacuation coverage is available in the unlikely event of a medical emergency during the tour. Please request this at the time of booking.

  14. LIABILITY

    Angara Tours and Travel and the organizer acts only as agents of the clients in all matters relating to the tour. The company’s liability is dictated by the local law of the country in which the tour takes place. However, the country takes no liability for delays, loss, any personal injury, illness infection or death of a client or damages from any cause whatsoever. We shall not be liable if any airline discontinues flights on any routings and change scheduled time tables resulting in missed connections etc. Should any amendment in a routing or itinerary be necessary we will requite you accordingly. Angara Tours and Travel deserves the right to employ subcontractors to carry out all or part of the services agreed to be supplied. Angara Tours and Travel’s liability to passengers carried in its own vehicles I governed by the respective laws of the country. All claims are subject to jurisdiction of the courts of the country in which the cause of action arises. Every effort will be made to adhere to the itinerary, but no rebate will be considered should we fail.

  15. LOSS OR DAMAGE OF PROPERTY

    Angara Tours and Travel accepts No liability whatsoever for the theft of or loss or damage to the property of any client howsoever caused.

  16. GOVERNING LAW

    These terms and conditions shall be read and construed in all aspects in accordance to with laws of the respective local destination’s government (Eg Uganda) and the company and the organizer and the company shall submit to the respective jurisdiction of the respective court.

  17. FORCE MAJEURE

    Force Majeure means those circumstances where the performance of our contract with you is prevented or affected by reasons of war, threats of war, civil strife, industrial dispute, terrorist activities, natural or nuclear disaster, fire, adverse weather conditions, government actions and similar actions beyond our control. In these circumstances we shall not be liable for any form of compensation or otherwise responsible for any expenses or losses the clients might incur. If we are forced to cancel, delay, curtail or change the arrangements in any way, or where the performance or prompt performance of our contractual obligation is affected or prevented.
